Los Angeles Property Division Attorney
Vincent W. Davis, Founder & Attorney at Law
The Stakes Are Too High to Divide Assets Alone
Without an experienced property division attorney in Los Angeles, you risk:
- Losing your rightful share of the family home, business, or investment properties
- Retirement accounts and pensions divided incorrectly, costing you decades of savings
- Separate property you owned before marriage absorbed into the community estate
- Hidden assets, undervalued businesses, and concealed accounts going undiscovered
- Signing a settlement that permanently waives reimbursements you never knew existed
The reality? California law requires community property to be divided equally, but “equal” only applies to what gets counted, characterized, and valued correctly. The difference between a fair settlement and a devastating one often depends on having skilled property division representation from day one.

Understanding California Property Division Law in Los Angeles County
California is a community property state under Family Code Section 760, which presumes that assets acquired during the marriage belong equally to both spouses. Unlike “equitable distribution” states where judges divide property based on fairness, Family Code Section 2550 requires Los Angeles courts to divide the community estate exactly equally, a strict 50/50 split unless both spouses agree otherwise.
Critical legal protections for divorcing spouses include:
- Separate property rights preserving assets owned before marriage, plus gifts and inheritances, from division
- The date of separation cutoff, after which your earnings become yours alone
- Fiduciary duties requiring both spouses to fully disclose every asset, debt, and account
- Reimbursement rights for separate funds contributed to community property, such as a home down payment
- Severe penalties for hiding assets, courts can award the innocent spouse 50% or even 100% of any concealed asset
That last protection has teeth. In one famous Los Angeles County case, a wife concealed a $1.3 million lottery prize from her husband during their divorce. When the concealment surfaced, the court awarded him every penny of it, all because she hid an asset she otherwise would have split.
Understanding these protections is crucial when dividing property in a Los Angeles divorce. Many spouses unknowingly waive reimbursement claims, mischaracterize assets, or accept valuations that cost them tens of thousands of dollars.
Our strategies focus on making sure every asset is found, properly characterized, and accurately valued before anything is divided.
The Vincent W. Davis & Associates Difference
Our Los Angeles property division attorneys bring deep community property expertise, combining aggressive advocacy with genuine understanding of what these assets represent, years of work, sacrifice, and plans for the future.
We recognize that property division demands both financial precision and long-term strategic thinking, because the settlement you sign today determines the life you rebuild tomorrow. Our multilingual staff (Spanish, Russian, Chinese, Vietnamese, and English) ensures clear communication when every disclosure and every valuation matters.
Time Is Not On Your Side
Delaying legal assistance can permanently damage your financial future. Accounts get drained. Assets get moved or retitled. Records disappear. Valuation dates pass. Settlement positions weaken.
Our attorneys can protect your property rights and preserve your claims to reimbursements and credits, but only if you act before time-sensitive opportunities vanish.
